Summary
Competitive allocation of concessions can be an effective mechanism to leverage competitive tension in the market to drive better outcomes for public conservation land (PCL). Current legislative settings mean DOC must take a ‘first in, first served’ approach when concession applications are received. This means that while concessions can technically be competitively allocated, there is ambiguity about when and how this can be used.
The objectives of the options assessed in this Regulatory Impact Statement (RIS) are to ensure the framework for competitive allocations provides for high performing activities on PCL including when significant private investment is needed.
Key options assessed in this RIS will:
- enable competitive allocation of concession opportunities on PCL
- clarify what is required to give effect to the principles of the Treaty of Waitangi in these decisions
- define circumstances in which major commercial opportunities on public conservation land may (or may not) be contestable.
